These terms and conditions constitute a binding legal contract between you and The AutoAuditor. By visiting our website at www.theautoauditor.com or ordering an inspection with The AutoAuditor, you are agreeing to be bound by these terms and conditions. The rights and obligations in your agreement with The AutoAuditor are personal to you, and not transferable to another party. You must be at least 18 years old to order an inspection with The AutoAuditor.
When you place your order with The AutoAuditor, you are hiring us to evaluate the overall condition of the designated vehicle, based on what our inspectors can subjectively observe. The AutoAuditor inspectors do not use hoists or tools and do not dismantle vehicles. Our service is a visual inspection of all reasonably accessible items only; therefore, some underlying, internal, or intermittent problems may not be observable during the inspection. The AutoAuditor inspector will attempt to test drive the vehicle, but if this is not feasible due to safety, insurance, road conditions, or seller restrictions, a test drive will not be conducted. Once the inspection is completed, you will receive a comprehensive report via email or WhatsApp, along with a package of photographs of the vehicle.
The AutoAuditor performs independent evaluation and inspection services only. The AutoAuditor is not affiliated with the seller of the vehicle and does not take a definitive stance on whether you should, or should not, purchase the vehicle. The AutoAuditor does not verify that the seller has the legal right or clear title to sell the vehicle, and is not responsible for any representations made by the seller or any other third party.
An inspection does not act as a warranty or as an insurance policy for any vehicle. You acknowledge and agree that if you purchase any vehicle inspected by The AutoAuditor, you are fully responsible for all subsequent costs for repairs and maintenance on your vehicle, whether or not covered by any other insurance policy or factory warranty. The final decision to purchase any vehicle remains entirely your own responsibility.
Because the vehicle being inspected is a pre-owned asset, you agree that, even after our inspection, you are purchasing the vehicle in an "as is" condition, unless otherwise explicitly warranted by the seller. Because a vehicle's mechanical condition may alter or degrade between the time the inspection is conducted and the actual financial purchase, we recommend having the inspection completed as close in time to the purchase transaction as possible. The AutoAuditor report is an independent evaluation and is not a substitute for any official safety or emissions inspections that may be required by local state laws.
The AutoAuditor inspections may be affected by adverse weather, poor ambient lighting conditions, as well as the overall cleanliness of the vehicle (both inside and out) at the time of evaluation. External factors beyond our control can reduce visual accuracy, making structural cosmetic fixes like minor repainting and body work difficult to detect with the naked eye. For the most accurate inspection results, the vehicle should ideally be clean, dry, and situated in a well-lit location. The AutoAuditor does not clean or dismantle components to alter the vehicle's state during inspection.
For packages or offerings that include logistical coordination or full-service assistance, any vehicle pickup, transport, and drop-off arrangements are conducted entirely at the customer’s sole risk. The AutoAuditor, its representatives, and independent contractors assume absolutely no legal liability, accountability, or financial responsibility for any accidents, mechanical breakdowns, structural damages, third-party claims, or traffic violations that may occur while the vehicle is being picked up, driven, in transit, or dropped off. All risks and liabilities during movement remain strictly with the customer or the vehicle owner's comprehensive insurance policy coverages.
For Pre-Delivery Inspections (PDI) conducted on brand new, unregistered vehicles at authorized brand dealerships, the service is strictly a point-in-time aesthetic and functional baseline checklist. The AutoAuditor does not provide any alternative or parallel warranty to the manufacturer’s factory warranty. We assume no liability if a dealership refuses to rectify flaws highlighted in our report, nor are we liable for manufacturing defects, internal component tolerances, or transit damage hidden by the factory finish that manifest after the vehicle leaves the showroom floor.
All market recommendations, vehicle selection guidance, and price negotiations conducted under our Advisory or Concierge packages are purely consultative and executed on a best-effort basis. The AutoAuditor does not guarantee the lowest market pricing, nor do we act as a financial escrow agent. All direct monetary transactions, bookings, token advances, and registration paperwork transfers must take place exclusively between the customer and the seller/dealership. The AutoAuditor is never a party to the vehicle's bill of sale or financial exchange.
While our inspectors evaluate wear and tear indicators meticulously, advanced digital odometer tampering or malicious software rewrites to a vehicle's Electronic Control Unit (ECU) cannot always be uncovered during a standard on-site visual check without manufacturer-level deep diagnostic hardware. The AutoAuditor assumes no financial liability for deeply hidden digital odometer fraud, rolled-back mileages, or suppressed dashboard fault codes intentionally cleared prior to our arrival.
ALL SERVICES FROM THE AUTOAUDITOR ARE PROVIDED ON AN "AS IS, WITH ALL DEFECTS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. YOU ACKNOWLEDGE THAT USE OF OUR SERVICES IS AT YOUR SOLE RISK. YOU AGREE THAT THE AUTOAUDITOR'S LIABILITY IS STRICTLY LIMITED TO REFUNDING THE EXACT PRICE YOU PAID TO US FOR THE INSPECTION SERVICE. IN NO EVENT WILL EITHER THE AUTOAUDITOR OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OUR DISCLOSURES OR SERVICES.
Once your booking order is formally processed, all sales are final. The AutoAuditor may decline to undertake a requested inspection at our sole discretion, in which case your prepaid fee will be promptly refunded. Furthermore, if The AutoAuditor is prevented from performing the inspection due to circumstances beyond its control (computer malfunctions, restrictive local regulations, weather limits, safety hazards, or acts of God), we are excused from further performance obligations.
If you believe there are material inaccuracies in your delivered inspection report, you must submit your specific dispute along with detailed pictures to contact@theautoauditor.com within seven (7) days of delivery for refund consideration. Due to the highly volatile and complex mechanical nature of automobiles, no adjustment submissions will be reviewed after this 7-day period has elapsed.
You agree to communicate exclusively with the core team of The AutoAuditor regarding your vehicle inquiry and to never contact any field inspector directly. If you attempt to bypass our network, contact field staff directly without written consent, or remove The AutoAuditor from the processing framework, we reserve the immediate right to terminate the agreement and retain your service payment.
This Policy and any obligations arising from or in connection with it shall be governed exclusively by the laws of the Republic of India. Any legal disputes or differences relating to matters set out within this text shall fall under the exclusive jurisdiction of the competent courts of Bengaluru, Karnataka.
